Terms of Service

1. Acceptance of Terms

By accessing or using the Torqd mobile application and website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 16 years old to use Torqd. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you must have the consent of a parent or legal guardian.

3. Your Account

You are responsible for maintaining the security of your account credentials. You agree not to share your account with others or allow unauthorized access. You are responsible for all activity that occurs under your account.

You must provide accurate information when creating your account. We reserve the right to suspend or terminate accounts that contain false or misleading information.

4. Acceptable Use

You agree not to use Torqd to:

• Violate any applicable laws or regulations
• Promote or glorify dangerous, reckless, or illegal driving behavior
• Harass, bully, threaten, or intimidate other users
• Post content that is defamatory, obscene, or infringes on the rights of others
• Impersonate another person or entity
• Manipulate leaderboards, segment times, or other competitive features through cheating, GPS spoofing, or data manipulation
• Attempt to gain unauthorized access to other users' accounts or data
• Use automated systems (bots, scrapers) to access the Service
• Interfere with or disrupt the Service or its infrastructure
• Upload viruses, malware, or other harmful code

5. Safe Driving

Torqd is designed to enhance the driving experience, not to encourage unsafe behavior. You are solely responsible for your driving and must always obey traffic laws and drive safely.

• Do not interact with the app while driving. Set up navigation before you start.
• Segment competitions and leaderboards are not an invitation to speed or drive recklessly.
• Speed data and performance metrics are for personal reference only.
• Torqd is not responsible for any accidents, injuries, fines, or damages resulting from your driving.

6. User Content

You retain ownership of content you create on Torqd (drive data, photos, comments, posts). By posting content on the Service, you grant Torqd a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and promoting the Service.

You are responsible for the content you post. We may remove content that violates these Terms or our community guidelines. We may also hide, flag, or restrict content based on user reports and moderation decisions.

7. Groups and Communities

Torqd allows users to create and join groups. Group administrators are responsible for managing their communities. Torqd reserves the right to remove groups or group content that violates these Terms.

8. Premium Features

Torqd may offer premium subscription plans with additional features. Subscriptions are billed through the Apple App Store or Google Play Store and are subject to their respective terms. You may cancel your subscription at any time through your device's subscription management settings.

Refunds are handled according to the policies of the Apple App Store or Google Play Store. We do not process refunds directly.

9. Intellectual Property

The Torqd name, logo, design, and all associated visual elements are the property of Torqd. You may not use our trademarks, logos, or branding without prior written permission.

The Service, including its code, design, features, and documentation, is protected by copyright and other intellectual property laws.

10. Reporting and Moderation

Users can report content or other users that violate these Terms. We review reports and may take action including warnings, content removal, temporary suspension, or permanent bans. We aim to review reports promptly but do not guarantee specific response times.

Abuse of the reporting system (false or frivolous reports) may result in action against the reporting user.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause and with or without notice, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately.

You may delete your account at any time through the app settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

GPS data, speed measurements, navigation directions, and other information provided by the Service are approximate and should not be relied upon for safety-critical decisions. Always use common sense and obey traffic laws.

13. Limitation of Liability

To the maximum extent permitted by law, Torqd and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

14. Indemnification

You agree to indemnify and hold harmless Torqd from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
